Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and RecipeMe ("we," "our," or "us") regarding your use of the RecipeMe mobile application (the "App").

By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

RecipeMe is a mobile application that provides:

• AI-powered ingredient detection from photos taken with your device camera
• Automated recipe generation based on detected ingredients
• Recipe saving and organization features
• Personal seasonings and spices inventory management
• Customized recipe recommendations based on your available ingredients

The App uses artificial intelligence technology provided by OpenAI to analyze photos and generate recipe suggestions. Results may vary in accuracy and completeness.

3. Eligibility

To use RecipeMe, you must:

• Be at least 13 years of age (or the age of digital consent in your jurisdiction)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the App under applicable laws
• Provide accurate and complete registration information

If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. User Accounts

4.1 Account Creation

• You must create an account to access certain features of the App
• You may sign up using email/password, Google, or Apple Sign-In
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate, current, and complete information during registration

4.2 Account Security

• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach
• You may not share your account with others or allow others to access your account
• We are not liable for any loss or damage arising from your failure to protect your account

4.3 Account Termination

• You may delete your account at any time through the App settings
• Account deletion is permanent and irreversible
• All your data (recipes, photos, seasonings, profile) will be permanently deleted
• We reserve the right to suspend or terminate accounts that violate these Terms

5. Acceptable Use Policy

5.1 Permitted Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You may:

• Take photos of ingredients for recipe generation
• Save and organize recipes generated by the App
• Manage your personal seasonings inventory
• Share recipes through supported sharing features

5.2 Prohibited Conduct

You agree NOT to:

• Upload photos containing offensive, illegal, or inappropriate content
• Use the App to generate recipes for commercial purposes without permission
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scripts) to access the App
• Interfere with or disrupt the App's functionality or servers
• Collect or harvest user data without authorization
• Impersonate others or misrepresent your affiliation
• Upload content that infringes intellectual property rights
• Transmit viruses, malware, or harmful code
• Use the App in any way that violates applicable laws

5.3 Content Guidelines

Photos you upload must not contain:

• Illegal substances or contraband
• Offensive, explicit, or inappropriate imagery
• Personal information of others without consent
• Copyrighted or trademarked content you don't own

6. Intellectual Property Rights

6.1 Our Intellectual Property

RecipeMe and all its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. This includes:

• The App's design, layout, and user interface
• The RecipeMe name, logo, and branding
• Proprietary algorithms and recipe generation methods
• Documentation, graphics, and text

You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

6.2 Your Content

You retain ownership of photos you upload and recipes you create or modify. By using the App, you grant us:

• A worldwide, non-exclusive license to store and process your photos for recipe generation
• Permission to use your data to improve our AI models and services
• The right to display your saved recipes within your account

This license terminates when you delete your content or account.

6.3 AI-Generated Recipes

• Recipes generated by our AI are provided "as-is" for your personal use
• You may use generated recipes for personal, non-commercial purposes
• We do not claim copyright over individual recipe instructions or ingredients lists
• However, our proprietary recipe generation system remains our intellectual property

7. Disclaimers and Limitations

7.1 "As-Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Non-infringement of intellectual property rights
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation

7.2 Recipe Accuracy and Food Safety

7.3 Third-Party Services

The App uses third-party services (OpenAI, Supabase, Sentry) that have their own terms and policies. We are not responsible for:

• Availability or performance of third-party services
• Third-party data handling practices
• Changes or discontinuation of third-party services

7.4 Internet Connectivity

The App requires internet connectivity for most features. We are not responsible for:

• Limited functionality due to poor or no internet connection
• Data charges from your mobile carrier
• Service interruptions due to network issues

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
• OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS (WHICHEVER IS GREATER)
• WE ARE NOT LIABLE FOR FOOD SAFETY ISSUES, ALLERGIC REACTIONS, OR ILLNESS RESULTING FROM RECIPE USE
• WE ARE NOT LIABLE FOR ERRORS IN INGREDIENT DETECTION OR RECIPE GENERATION

Some jurisdictions do not allow limitation of liability for certain types of damages, so some limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless RecipeMe, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload to the App
• Food safety issues or illness from recipes you prepare

10. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Key privacy points:

• We collect photos, recipes, and account information
• Photos are processed by OpenAI's AI for ingredient detection
• You can delete your data and account at any time
• We implement security measures but cannot guarantee absolute security

11. Modifications to the Service

We reserve the right to:

• Modify, suspend, or discontinue the App (or any features) at any time
• Change pricing or introduce fees for features currently free
• Update the App's functionality, design, or content
• Limit usage or impose restrictions on certain features

We will provide reasonable notice of material changes when possible, but are not obligated to do so.

12. Changes to These Terms

We may update these Terms from time to time. When we make changes:

• We will update the "Last Updated" date at the top
• We will notify you through the App or via email for material changes
• Continued use of the App after changes constitutes acceptance
• If you don't agree with new Terms, you must stop using the App

13. Termination

13.1 Termination by You

You may terminate your account at any time by using the delete account feature in the App settings. Termination is immediate and irreversible.

13.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your use poses security or legal risks
• Required by law or legal authority
• We cease operating the App

13.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• Your data will be deleted according to our Privacy Policy
• Sections of these Terms that should survive (disclaimers, limitations, indemnification) remain in effect

14. Governing Law and Disputes

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We will attempt to resolve disputes in good faith.

14.3 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court (except for small claims court).

14.4 Class Action Waiver

You agree to resolve disputes with us only on an individual basis, and not as part of a class action or representative proceeding.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RecipeMe regarding use of the App.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet service failures.

15.6 Export Compliance

You agree to comply with all applicable export laws and restrictions and shall not export or re-export the App to prohibited countries or individuals.

16. Apple App Store Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and RecipeMe, not with Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims relating to the App
• In the event of any third-party claim that the App infringes intellectual property rights, RecipeMe (not Apple) is responsible
• Apple and its subsidiaries are third-party beneficiaries of these Terms
• You must comply with applicable third-party terms when using the App

17. Feedback and Suggestions

We welcome your feedback and suggestions about the App. By submitting feedback, you agree that:

• Your feedback is voluntary and not confidential
• We may use your feedback without any obligation to you
• We are not required to compensate you for feedback
• We may incorporate your suggestions into the App without restriction
